Registering your entry-level driver training (ELDT) program on the Training Provider Registry (TPR) isn’t a one-and-done process. From updating key information to maintaining accurate training records, the Federal Motor Carrier Safety Administration (FMCSA) expects providers to continually manage their TPR information or risk being out of compliance.
As FMCSA ramps up audits of ELDT providers, knowing what’s expected is essential. If your program is not in compliance, you could be removed from the TPR and unable to continue providing ELDT.
Section 380.725 of the Federal Motor Carrier Safety Regulations (FMCSRs) lists the specific records that must be maintained by all ELDT providers. These records serve as proof that the provider is delivering instruction in accordance with federal standards and documenting driver-trainee progress appropriately.
During an ELDT audit, an investigator will ask for and review the following records:
• Self-certifications by all behind-the-wheel driver-trainees stating that they will comply with:
o The regulations in Parts 40, 382, 383, and 391; and
o Any state and/or local laws related to alcohol and controlled substances testing, age, medical certification, licensing, and driver records;
• A copy of each driver-trainee’s commercial learner’s permit (CLP) or commercial driver’s license (CDL);
• Instructor qualification documentation:
o Listing each instructor’s driving and/or training experience, and
o A copy of each instructor’s current and valid CDL and applicable endorsements;
• Lesson plans for theory and behind-the-wheel (range and public road) training curricula; and
• Records of each driver-trainee’s ELDT assessments.
These records must be retained for at least three years from the date each is created or received. Records that have expired, such as an instructor’s CDL, may be replaced with the current, valid version. If local, state, or federal requirements require longer retention periods, the records should be maintained under those guidelines.
To remain on the TPR, a provider needs to periodically review and update their profile information. This includes:
• Updating the Entry-Level Driver Training Provider Registration Form at least once every two years (biennially); and
• Reporting changes to key information to FMCSA within 30 days of the change. This includes changes to the:
o Training provider’s name, address, or phone number;
o Type(s) of training offered; and
o Training provider’s status, and, if applicable, any change in state licensure, certification, or accreditation status.
The FMCSA is also monitoring training provider activity in the TPR. The agency is sending notices to training providers that have not submitted any certifications of driver training completion within the past 12 months.
Training providers that receive this notice should carefully follow the instructions provided and respond directly to the FMCSA.
Beyond the federal ELDT standards, many states impose additional rules on schools and entities that provide CDL training. In many cases, these requirements apply to schools or entities that offer instruction for tuition or a fee.
When applying to be listed on the TPR, each provider must certify that they are properly licensed, certified, registered, or otherwise authorized to offer training under the laws and regulations of the state where in‑person instruction occurs.
During an audit, investigators will request documentation showing the provider’s state licensure, registration, or certification. This helps confirm that the provider is legally authorized to train in that state and that the information certified on the TPR application is accurate and up to date.
